1. About these Terms

These Terms of Use are a legal agreement between you and Sivaiah Technologies Inc., a federally incorporated Canadian corporation that owns and operates Bulbul.

In these Terms:

  • Bulbul,” “we,” “us,” and “our” mean Sivaiah Technologies Inc.;
  • Candidate” means a person using Bulbul for job-search, resume, application, public-profile, sourcing, or related career services;
  • Employer” means a company or organization using Bulbul to publish jobs, review applicants, source candidates, or manage recruitment;
  • Employer User” means an owner, administrator, recruiter, hiring manager, or other authorized person using an Employer account;
  • Services” means the websites, accounts, job-posting functions, applications, messaging, sourcing, resume tools, paid services, automated features, and other functionality provided through Bulbul;
  • User Content” means information, documents, messages, resumes, applications, job postings, company information, photographs, links, and other content submitted through the Services.

These Terms apply to:

  • bulbul.ca;
  • employers.bulbul.ca;
  • Candidate and Employer accounts;
  • the Bulbul Professional Resume Service;
  • related emails, communications, payment pages, and services.

Bulbul is a product of and is operated by:

2. Acceptance of these Terms

By creating an account, accepting an Employer invitation, purchasing a service, or otherwise using Bulbul after being presented with these Terms, you agree to be bound by them.

Registered Users will be asked to confirm:

I agree to the Terms of Use and acknowledge the Privacy Policy.

Bulbul may record:

  • the version of the Terms accepted;
  • the date and time of acceptance;
  • the account accepting them;
  • the applicable Privacy Policy version;
  • any separate paid-order terms or optional consents.

The Privacy Policy explains how Sivaiah Technologies Inc. handles personal information. Privacy choices that require separate consent—including optional analytics, public-profile indexing, marketing, and candidate sourcing—are not granted merely by accepting these Terms.

If you do not agree to these Terms, do not create an account, purchase a service, or use restricted portions of Bulbul.

3. Changes to these Terms

We may amend these Terms to reflect changes to:

  • the Services;
  • fees or usage limits;
  • legal or regulatory requirements;
  • security, fraud-prevention, or platform rules;
  • business and operational practices.

For material changes, we may provide advance notice through the website, your account, or email. Your continued use after the effective date constitutes acceptance where permitted by law.

We will request renewed acceptance where required by law or where a change materially alters your obligations, payment commitments, dispute rights, or use of the Services.

Changes will not retroactively remove rights already accrued under mandatory law.

4. Eligibility

You may register only if you:

  • have reached the age of majority in the province or territory where you reside;
  • have legal capacity to enter into these Terms;
  • provide accurate registration information;
  • are not prohibited by law from using the Services.

If we reasonably believe that a User has not reached the applicable age of majority, we may restrict or disable the account while investigating.

Candidates may maintain one Candidate account. A Candidate may separately maintain one Employer account where they are legitimately authorized to act for an Employer.

You must not:

  • create duplicate accounts to evade restrictions;
  • create an account for another person without authorization;
  • impersonate another person or organization;
  • sell, transfer, lease, or share an account;
  • share passwords, sign-in links, or authentication credentials;
  • allow another person to use your account.

You are responsible for activity performed through your account unless it results from a security failure for which Bulbul is legally responsible. You must promptly notify us of suspected unauthorized access.

5. Bulbul’s role

Bulbul provides technology for:

  • job discovery;
  • job postings;
  • applications;
  • candidate and Employer profiles;
  • recruitment workflows;
  • messaging;
  • candidate sourcing;
  • resume creation and analysis;
  • professional resume services.

Except for providing these Services, Bulbul:

  • is not the employer for jobs posted on the platform;
  • does not employ Candidates for posted opportunities;
  • does not negotiate employment agreements or compensation;
  • does not conduct interviews on behalf of Employers;
  • does not make final hiring decisions;
  • does not currently provide background, reference, credential, immigration, or work-authorization checks;
  • does not act as a recruiter representing a particular Employer;
  • does not receive a commission when a Candidate is hired.

Employers determine job requirements and make all hiring decisions.

Candidates are not charged to browse or apply for jobs. The optional Bulbul Professional Resume Service is a separate paid career service and does not provide preferential treatment in applications or hiring.

6. No employment or hiring guarantee

Bulbul does not guarantee:

  • that a job posting or Employer is genuine, accurate, solvent, safe, or suitable;
  • that a Candidate is qualified, truthful, available, or suitable;
  • that an Employer will review or respond to an application;
  • interviews, offers, employment, promotions, salaries, or career outcomes;
  • a particular number or quality of applicants;
  • successful recruitment or hiring;
  • work authorization, immigration eligibility, licensing, or credential recognition;
  • that a job or Candidate profile will appear in search-engine results;
  • search-engine ranking, traffic, or indexing;
  • the accuracy or availability of ATS, matching, ranking, or AI-assisted tools.

Employer verification and job review are risk-reduction measures. They are not endorsements, guarantees, legal opinions, credit checks, or certifications of every statement made by an Employer.

Candidates and Employers must independently assess one another and use reasonable caution.

7. Candidate responsibilities

Candidates must:

  • provide information that is accurate to the best of their knowledge;
  • keep account and contact information reasonably current;
  • be authorized to submit all resumes, applications, photographs, portfolios, links, references, and other materials;
  • ensure that submitted content does not violate another person’s intellectual-property, privacy, confidentiality, or contractual rights;
  • not knowingly make false statements about employment, education, qualifications, credentials, achievements, references, work authorization, or identity;
  • review application materials and AI-assisted content before using or submitting them;
  • communicate lawfully and professionally with Employers;
  • comply with applicable law.

Bulbul may rely on information supplied by a Candidate and does not ordinarily verify employment history, education, credentials, accomplishments, references, or work authorization.

Candidates should not submit unnecessary sensitive information, including:

  • Social Insurance Numbers;
  • government-identification numbers;
  • banking or payment-card information;
  • account passwords;
  • medical information;
  • dates of birth;
  • protected demographic information;
  • confidential information belonging to an employer or other third party;
  • another person’s personal information without authority.

8. Candidate applications

A Candidate may submit only one Bulbul application for a particular job posting.

Withdrawing an application does not create a right to submit another application for the same posting. An Employer may reconsider or reopen the existing application where Bulbul permits.

When a Candidate applies, Bulbul may preserve an application-time copy of the submitted profile, resume, cover letter, answers, skills, and other application information. Later changes to the Candidate’s live profile do not necessarily alter the previously submitted application.

When an application is withdrawn:

  • it is removed from active hiring consideration;
  • it is not necessarily deleted;
  • the Employer may retain access to the application-time information, previous messages, status history, and lawful hiring records;
  • the Employer must not continue recruitment communications about that withdrawn application unless the Candidate requests or consents to further contact, except for necessary administrative, safety, legal, or recordkeeping communications.

External application websites may impose their own application and duplicate-submission rules.

9. Employer eligibility and authority

An Employer User represents and warrants that they:

  • are authorized to act for and, where applicable, bind the Employer;
  • have provided accurate company information;
  • are authorized to submit company and verification documents;
  • will use Bulbul only for legitimate recruitment and hiring purposes;
  • will comply with these Terms and applicable law.

Recruitment agencies, staffing agencies, and temporary-help agencies may use Bulbul only if they:

  • hold every licence or registration required for their activities;
  • accurately identify the actual hiring arrangement;
  • comply with worker-fee restrictions;
  • do not charge Candidates prohibited recruitment or placement fees;
  • comply with applicable employment, privacy, immigration, human-rights, accessibility, and temporary-help-agency laws.

10. Foreign Employers and Canadian opportunities

An Employer established outside Canada may use Bulbul only to recruit for genuine opportunities located in Canada or genuinely available to people working in Canada.

Foreign Employers must:

  • provide acceptable Canadian or foreign business documentation;
  • accurately identify the company and opportunity;
  • comply with Canadian laws applicable to the posting, recruitment activity, and Candidate information;
  • use Candidate information only for legitimate recruitment;
  • accept that Candidate information may remain subject to Canadian privacy requirements;
  • cooperate with Bulbul’s verification and review procedures.

Bulbul may flag foreign Employers or jobs for additional review and may reject or remove opportunities that do not have a sufficient Canadian connection.

11. Employer verification

Bulbul may request business-registration, incorporation, amalgamation, business-number, charter, or comparable documents.

Bulbul may:

  • approve or reject an Employer;
  • request corrections or further information;
  • require resubmission;
  • re-review an approved Employer;
  • suspend an Employer while investigating;
  • revoke access where information is false, incomplete, outdated, or unreliable.

Employers should redact unrelated personal information where legally permitted.

Approval does not mean that Bulbul guarantees:

  • the Employer’s identity beyond the checks performed;
  • the Employer’s financial condition;
  • the accuracy of every job;
  • that the Employer will comply with law;
  • the quality or safety of the working environment.

12. Employer teams

Employer accounts may include owners, administrators, recruiters, hiring managers, and other approved roles.

The Employer owner and administrators are responsible for:

  • inviting only authorized personnel;
  • assigning appropriate permissions;
  • removing access promptly when no longer required;
  • maintaining control over company accounts;
  • activities performed by Employer Users;
  • ensuring team members comply with these Terms.

The current Employer team limit is 10 seats, including:

  • the owner;
  • active team members;
  • pending invitations.

Invitations are personal to the invited email address and must not be transferred.

Bulbul may change seat limits, role functions, permissions, or plan availability with reasonable notice where appropriate.

13. Employer usage and posting limits

Employer accounts and job posting are provided without an Employer subscription under these Terms. An Employer may have up to 10 jobs simultaneously published and unexpired. Drafts do not count toward that active-job allowance, and an Employer may store up to 100 drafts at one time. Submitting, deleting, or archiving a draft releases its draft space. Closing a published job, or allowing it to expire, releases its active slot. Jobs awaiting review do not reserve an active slot, so a job may remain pending if another publication uses the final available slot before approval.

Bulbul may modify:

  • posting limits;
  • sourcing limits;
  • usage quotas;
  • seat limits;
  • feature availability.

Bulbul will provide appropriate notice of material limit changes. No Employer subscription fee or recurring Employer charge will be imposed without separate terms, clear advance disclosure, and any agreement required by law.

14. Job-posting requirements

Every Employer must ensure that each job posting:

  • represents a genuine and current opportunity;
  • is authorized by the Employer;
  • is located in Canada or genuinely available to people working in Canada;
  • accurately describes the title, responsibilities, qualifications, compensation, work location, remote status, schedule, employment type, application process, and expiry;
  • complies with employment, human-rights, accessibility, privacy, immigration, anti-spam, wage-transparency, advertising, and recordkeeping laws;
  • is updated or closed when no longer available.

An Employer must not publish a job that:

  • is fraudulent, deceptive, misleading, or unlawful;
  • unlawfully discriminates against applicants;
  • contains harassment, threats, hate, or abusive material;
  • is primarily advertising, lead generation, or resume collection rather than a genuine job;
  • requires a Candidate to pay an unlawful application, recruitment, training, equipment, placement, or hiring fee;
  • is part of a pyramid, advance-fee, or similar fraudulent arrangement;
  • requests passwords, banking credentials, payment-card information, or unnecessary identification;
  • contains malware, deceptive redirects, or unsafe links;
  • misrepresents compensation, location, work conditions, or the identity of the hiring organization;
  • infringes intellectual property or confidentiality obligations;
  • otherwise presents material legal, security, or safety concerns.

Bulbul may reject, close, de-index, archive, suspend, or remove a job that violates these requirements.

15. Job-review and publication lifecycle

Jobs may move through states such as:

  • draft;
  • submitted;
  • under review;
  • published;
  • rejected;
  • closed;
  • archived.

Jobs ordinarily use a 30-day posting period.

An Employer may extend an eligible job. Each selected expiry date may be no more than 90 days in the future, although repeated extensions may be permitted. Bulbul does not promise that a job may remain active indefinitely.

Material changes may require renewed review.

Bulbul may make limited formatting, display, categorization, accessibility, or technical adjustments without changing the substantive meaning of the posting.

Approval does not guarantee:

  • legal compliance;
  • search-engine eligibility;
  • indexing or ranking;
  • views or applications;
  • successful hiring.

16. Employer compliance with job-posting laws

Employers are responsible for determining which laws apply to their organization and postings.

Where required, an Employer must:

  • include prescribed compensation information;
  • state whether the posting concerns an existing vacancy;
  • disclose whether artificial intelligence is used to screen, assess, or select applicants;
  • avoid prohibited Canadian-experience requirements;
  • provide required notices to interviewed applicants;
  • retain copies and versions of job postings and associated application forms;
  • satisfy applicable fraudulent-posting, recordkeeping, accessibility, and disclosure obligations.

Bulbul’s forms, prompts, checks, or reviews do not replace the Employer’s legal obligations.

17. Reporting fraudulent or improper jobs

Users may report a potentially fraudulent, misleading, discriminatory, unsafe, or otherwise improper job through the reporting mechanism displayed on Bulbul or by emailing:

support@bulbul.ca

A report should identify the job and explain the concern without including unnecessary sensitive information.

Bulbul may:

  • review the report;
  • request further information;
  • preserve relevant records;
  • contact the Employer;
  • restrict, close, suspend, or remove the job;
  • suspend or terminate an account;
  • refer a matter to an appropriate authority;
  • take no action where the available information does not support the report.

Bulbul does not guarantee that it will detect every fraudulent posting or that every report will lead to removal.

Bulbul’s separate fraudulent-job policy explains the reporting and review process in further detail.

Ontario requires job-posting platforms to maintain a conspicuous reporting procedure and written fraudulent-posting policy.

18. Employer use of Candidate information

Employers may use Candidate information only for legitimate recruitment relating to their organization.

Employers must:

  • restrict access to authorized team members with a need to know;
  • maintain appropriate safeguards;
  • use applications, sourcing information, messages, and notes only for lawful hiring purposes;
  • honour Candidate withdrawals and applicable privacy rights;
  • maintain lawful retention and deletion practices;
  • respond appropriately to access, correction, and deletion requests;
  • comply with privacy, employment, accessibility, human-rights, and anti-spam laws.

Employers must not use Candidate information for:

  • unrelated advertising or sales;
  • data brokerage;
  • credit, insurance, housing, or unrelated eligibility decisions;
  • surveillance;
  • unlawful background investigations;
  • discriminatory profiling;
  • identifying protected characteristics;
  • resale or disclosure to unauthorized third parties.

Employers may contact a Candidate by telephone or email after the Candidate voluntarily applies, subject to applicable law and the Candidate’s choices.

19. Public Candidate profiles

Candidate public profiles are optional and off by default.

A Candidate may choose which supported profile fields are made public. Anyone with the link may be able to view, copy, print, save, photograph, or share the information.

Candidates must have the necessary rights to every photograph, portfolio item, link, document, and other public material.

Bulbul does not guarantee that third-party copies or caches will disappear when a public profile is disabled.

20. Search-engine indexing

Public-profile visibility and search-engine indexing are separate choices.

A Candidate must separately enable search-engine indexing. Turning a public profile off will also stop Bulbul’s future public presentation of the profile and disable indexing through Bulbul.

Turning indexing off may remove the profile from Bulbul’s indexing tools, but Bulbul does not control:

  • search-engine recrawl schedules;
  • cached copies;
  • archived pages;
  • copies made by other people;
  • search ranking or removal timing.

21. Candidate sourcing

Candidate sourcing is optional and off by default.

Candidates may separately select:

Allow verified employers recruiting for Canadian opportunities to discover a limited version of my professional profile.

This choice is separate from:

  • acceptance of these Terms;
  • public-profile visibility;
  • search-engine indexing;
  • sourcing email notifications.

A sourcing profile may include limited professional information such as:

  • initials;
  • professional headline;
  • skills;
  • job titles;
  • work history and durations;
  • education;
  • projects;
  • leadership experience;
  • target roles and professional interests.

It is designed to exclude direct contact information and other specified fields, as described in the Privacy Policy.

Sourcing profiles are pseudonymous, not guaranteed anonymous. Uncommon career details may make a Candidate recognizable.

Candidates may disable sourcing through their settings. Disabling sourcing prevents future sourcing discovery, subject to reasonable processing time. Existing invitations, blocks, reports, audit records, and information already viewed or lawfully retained may remain.

22. Employer sourcing rules

Only approved Employers with verified access and an active published Bulbul job may use Candidate sourcing.

Employers may use sourcing solely to identify potential Candidates for genuine Canadian opportunities and invite them to apply through Bulbul.

The current company-wide free allowance is 50 uncached sourcing searches per UTC week, resetting Monday at 00:00 UTC. A repeated cached search does not use another search. Profile opens, invitations, AI explanations, job-quality checks, burst controls, and other safeguards may have separate daily or shorter-period limits displayed in the Employer portal. Bulbul may change plan quotas with appropriate notice.

Employers must not:

  • attempt to re-identify a sourced Candidate;
  • compare sourcing information against external databases or social networks to identify the Candidate;
  • scrape, copy, download, export, or build a database of sourced profiles;
  • share sourcing information outside the authorized hiring team;
  • contact a sourced Candidate outside Bulbul before the Candidate applies;
  • circumvent a block, decline, quota, or invitation limit;
  • use sourcing information for advertising, sales, surveillance, credit, insurance, housing, or unrelated purposes;
  • infer protected characteristics;
  • sell or disclose sourcing information;
  • use sourcing information to train another AI system.

A Candidate may separately publish contact information through a public profile. If an Employer uses publicly disclosed contact information, the Employer remains responsible for complying with privacy, anti-spam, employment, and other applicable laws.

23. Candidate blocking

When a Candidate blocks an Employer:

  • the Employer is prevented from discovering or inviting that Candidate through sourcing;
  • existing applications are not automatically deleted;
  • prior messages and hiring records may remain;
  • communications associated with an existing application may continue unless the Candidate withdraws or applicable restrictions apply;
  • Bulbul may retain the block, report, investigation, and limited audit records for safety, enforcement, and dispute purposes.

24. Messaging and Employer notes

Messages must relate to legitimate job-search, application, recruitment, support, or platform activity.

Users must not send:

  • harassment, threats, or discriminatory content;
  • spam or deceptive communications;
  • malware or unsafe links;
  • unlawful fee or payment requests;
  • unnecessary sensitive information;
  • content infringing another person’s rights.

Employer-private notes may be visible to authorized Employer team members. Employers remain responsible for ensuring that notes are lawful, relevant, professional, accurate where appropriate, and not discriminatory.

Users should not assume that messages are confidential from Bulbul. Bulbul may access or preserve messages when reasonably necessary for:

  • delivery and service operation;
  • support;
  • investigating a report;
  • fraud and safety;
  • legal compliance;
  • enforcing these Terms.

Read receipts and delivery indicators are operational tools and are not guaranteed proof of legal notice.

25. AI-assisted and automated features

Bulbul may use automated and AI-assisted tools for:

  • resume and ATS analysis;
  • resume preparation;
  • keyword and skills suggestions;
  • job and Candidate matching;
  • sourcing explanations;
  • job-description quality checks;
  • job-posting review;
  • fraud, security, and operational functions.

These tools may produce content that is:

  • incomplete;
  • inaccurate;
  • inconsistent;
  • outdated;
  • biased;
  • unavailable.

Users must independently review outputs before relying on them.

ATS feedback does not reproduce or guarantee the result produced by any Employer’s actual applicant-tracking system.

Matching and sourcing scores measure configured information overlap. They do not establish:

  • suitability;
  • honesty;
  • eligibility;
  • competence;
  • future performance;
  • whether a Candidate should be interviewed or hired.

Employers must not use a Bulbul score, ranking, ATS result, match explanation, or automated recommendation as the sole basis for screening, rejecting, advancing, interviewing, or hiring a Candidate.

Employers remain responsible for meaningful human consideration and lawful hiring decisions.

26. Automated job review

Bulbul may use automated systems to assess job postings against platform, quality, safety, and compliance criteria.

Some postings may be approved automatically when they pass the applicable checks. Flagged postings may be reviewed by authorized personnel.

Bulbul may reject, restrict, or remove a job where it:

  • fails platform requirements;
  • presents fraud or safety concerns;
  • appears unlawful or misleading;
  • requires further verification;
  • otherwise creates material risk.

Automated review does not constitute legal, employment, human-rights, accessibility, or regulatory advice.

An Employer may appeal a material job-review outcome by contacting support@bulbul.ca.

27. Prohibited manipulation of automated systems

Users must not:

  • insert malicious or deceptive instructions intended to manipulate Bulbul’s automated systems;
  • attempt to extract confidential prompts, rules, models, credentials, or system information;
  • bypass safety, authorization, or usage limits;
  • use automated tools to infer protected characteristics;
  • deliberately cause discriminatory or harmful outputs;
  • interfere with job-review, ATS, matching, sourcing, security, or moderation systems.

28. Bulbul Professional Resume Service

28.1 Service description

The Bulbul Professional Resume Service includes:

  • one professionally prepared, ATS-friendly master resume;
  • up to two role-specific resume variants;
  • one PDF file and one editable DOCX file for each completed resume.

Cover letters, LinkedIn profiles, biographies, and other career documents are not included unless expressly identified in the order before payment.

The Service may be completed using a combination of human resume professionals and AI-assisted tools.

28.2 Price

The price, currency, applicable taxes, and total payable for the selected Service will be displayed before payment. The checkout summary is the authoritative price for that order.

Bulbul may change the price for future orders. A price change does not affect an order already accepted.

28.3 Service Start Date

Work begins only when:

  • Bulbul has confirmed successful payment; and
  • the Customer has provided all information reasonably required to prepare the deliverables.

That date is the “Service Start Date.”

If information is incomplete or unclear, Bulbul may request clarification and pause the delivery estimate until the required information is received.

28.4 Delivery estimate

Bulbul’s estimated delivery time is seven business days from the Service Start Date.

Business days exclude:

  • Saturdays and Sundays;
  • Canadian statutory holidays applicable to Bulbul’s operations.

This is an estimate rather than an absolute guarantee. Complex orders, incomplete information, service interruptions, or events outside Bulbul’s reasonable control may result in delay.

Bulbul will make reasonable efforts to notify the Customer of a material delay and provide an updated estimate.

This clause does not remove any mandatory right or remedy where Bulbul fails to provide an accepted paid service.

28.5 Customer information

The Customer is responsible for providing complete, accurate, current, and lawful information.

Bulbul:

  • may rely on the information supplied;
  • does not independently verify employment, education, credentials, achievements, references, or other claims;
  • will not knowingly fabricate qualifications;
  • may refuse or cancel work involving impersonation, fraud, deliberate misrepresentation, unlawful content, or infringement.

Substantial new information provided after work begins may:

  • pause or extend the delivery estimate;
  • fall outside the original scope;
  • require a separately disclosed and accepted fee.

28.6 Revision entitlement

The Service includes one consolidated revision round for the delivered resume package.

A revision round means the Customer submits all requested changes together and Bulbul returns one updated set of files.

The revision request must be submitted within seven calendar days after initial delivery.

An included revision may cover:

  • reasonable wording corrections;
  • clarification of supplied information;
  • changes in emphasis;
  • minor formatting preferences;
  • limited adjustments for target roles identified before work began.

The following may require a new order or separate fee:

  • a substantially different career objective;
  • a new profession or unrelated target role;
  • extensive new work, education, or project information;
  • rebuilding the resume after material changes to career history;
  • additional resume variants;
  • cover letters, LinkedIn summaries, or other documents;
  • additional revision rounds.

Bulbul will not classify a minor correction as a new order merely to avoid completing an included revision.

28.7 Bulbul-caused errors

Bulbul will correct its own:

  • spelling errors;
  • formatting errors;
  • transcription errors;
  • file-generation errors;
  • failures to follow confirmed instructions,

without additional charge and without counting the correction as the included revision round.

The Customer should report such errors promptly after discovering them.

28.8 No outcome guarantee

The Professional Resume Service promises only the stated deliverables and included revision process.

Bulbul does not guarantee:

  • interviews;
  • job offers;
  • employment;
  • salary;
  • promotion;
  • career success;
  • ATS acceptance, score, or ranking;
  • Employer response;
  • immigration or work authorization;
  • professional licensing;
  • that every Employer will prefer or accept the resume.

The Customer must review the final resume for accuracy before using it.

28.9 Cancellation before work begins

A Customer may cancel for a full refund before the Service Start Date.

A cancellation request should be made through the order page, where available, or by emailing support@bulbul.ca from the account email address and providing the order number.

28.10 Cancellation after work begins

Once work has begun, payments are generally non-refundable because the Service is customized and resources have been committed.

This does not limit:

  • mandatory consumer cancellation rights;
  • remedies for non-delivery;
  • remedies for material failure to provide the purchased service;
  • refunds for duplicate charges;
  • remedies where the deliverables materially differ from the order.

Subjective dissatisfaction alone does not create a refund right where Bulbul provides the stated deliverables and revision entitlement.

28.11 Refunds

Refunds may be approved where:

  • Bulbul cannot provide the Service;
  • Bulbul materially fails to provide the stated deliverables;
  • a material delivery failure is not reasonably corrected;
  • a duplicate payment occurs;
  • applicable law requires a refund.

Once approved, Bulbul will normally submit the refund to the payment processor within two business days. The Customer’s bank or payment provider may require additional time to post the credit.

28.12 Chargebacks

Customers are encouraged, but not required, to contact Bulbul before starting a chargeback.

While a payment dispute is open, Bulbul may:

  • pause undelivered work;
  • provide the payment processor with relevant order, acceptance, communication, delivery, and refund records;
  • avoid issuing a duplicate refund for the same transaction.

Bulbul will not intentionally disclose unnecessary resume information as chargeback evidence.

A chargeback alone will not automatically cause account termination. Fraud or repeated abuse may be reviewed separately.

28.13 Ownership of completed resumes

The Customer retains ownership of the information they supply.

After full payment, and to the extent Bulbul owns the applicable rights, Bulbul assigns to the Customer the rights in the customized final resume text specifically created for that Customer.

The Customer may use, reproduce, edit, and submit the completed resume for personal career and employment purposes.

Bulbul retains ownership of:

  • software;
  • underlying templates;
  • formatting systems;
  • methods;
  • prompts;
  • processes;
  • designs;
  • reusable components;
  • general know-how.

Bulbul may use a fully anonymized visual format or layout as an example, provided it does not include identifiable Customer information or confidential career content.

28.14 Online order process

Before payment, the Customer must be shown:

  • the Service description;
  • deliverables and exclusions;
  • currency, price, taxes, and total;
  • delivery estimate;
  • revision entitlement;
  • cancellation and refund summary;
  • Terms and Privacy Policy links;
  • an opportunity to review and correct the resume information used for the order;
  • an opportunity to accept or decline the order.

After purchase, Bulbul will provide a durable order record containing or making permanently available the applicable order details and accepted Terms version.

Ontario requires internet agreements above the prescribed threshold to satisfy disclosure and copy-delivery requirements and provides statutory cancellation rights for certain failures.

29. Payment processing

Payments may be processed by Stripe or another disclosed payment processor.

Payment processing may be subject to the processor’s terms and privacy practices.

Bulbul does not intentionally store complete payment-card numbers.

You authorize Bulbul and its payment processor to charge the amount displayed at checkout, including applicable taxes.

You must provide valid payment information and must not use a payment method without authorization.

30. User Content ownership and licence

Users retain ownership of their User Content, subject to rights belonging to others.

You grant Bulbul a limited, non-exclusive, worldwide licence to:

  • host;
  • store;
  • copy;
  • format;
  • validate;
  • process;
  • transmit;
  • display;
  • create application-time snapshots;
  • create sourcing projections where enabled;
  • index public content where authorized;
  • otherwise use User Content as reasonably necessary to provide, secure, and administer the selected Services.

For public company and job content, the licence includes displaying and distributing that content through Bulbul and authorized search or discovery channels.

The licence continues only as long as reasonably required to provide the Services and satisfy lawful retention, security, audit, fraud-prevention, payment, dispute, and backup requirements.

Employers may independently retain application information in accordance with their legal obligations.

31. User Content warranties

You represent that:

  • you own or have permission to submit the User Content;
  • the content is not knowingly false, fraudulent, defamatory, infringing, or unlawful;
  • submission does not violate confidentiality, employment, privacy, or contractual obligations;
  • you will not upload malicious files or instructions;
  • you have authority to provide personal information about another person where included.

Bulbul may remove, restrict, preserve, or disclose content as reasonably necessary to investigate violations, protect Users, or comply with law.

32. Bulbul intellectual property

Bulbul and its licensors own all rights in:

  • the platform and software;
  • branding and trademarks;
  • designs and layouts;
  • taxonomies and databases;
  • templates and reusable content;
  • documentation;
  • automated systems;
  • non-User content.

Subject to these Terms, Bulbul grants you a limited, revocable, non-exclusive, non-transferable licence to use the Services:

  • for personal job-search and career purposes as a Candidate; or
  • for internal lawful recruitment purposes as an Employer.

No other rights are granted.

33. Acceptable use

Except for ordinary search-engine crawling, personal feed-reader use, and uses expressly authorized by Bulbul, you must not:

  • scrape, crawl, harvest, copy, or bulk-download Bulbul content;
  • create a separate database from Bulbul information;
  • use automated systems to submit applications or messages;
  • conduct mass applications or mass outreach;
  • evade rate limits, quotas, blocks, or access controls;
  • reverse engineer or attempt to extract source code;
  • test security without written permission;
  • interfere with authentication, security, or service availability;
  • introduce malware or harmful code;
  • use Bulbul data to train or evaluate another AI model;
  • systematically copy Bulbul through competitive analysis;
  • resell, sublicense, or commercially exploit access;
  • impersonate another person or organization;
  • use Bulbul for fraud, discrimination, harassment, surveillance, or unlawful activity.

The public jobs RSS feed may be used by ordinary feed readers and authorized job-discovery services to display current job summaries with accurate attribution and a direct link to the Bulbul job page.

Feed users must:

  • respect the indicated refresh interval;
  • stop displaying removed or expired jobs;
  • not replicate the job database;
  • not use the feed for automated applications, AI training, resale, or unrelated profiling.

34. Feedback

You may provide feedback or suggestions.

You grant Bulbul a non-exclusive, perpetual, worldwide, royalty-free right to use feedback to improve or develop the Services, provided this does not transfer ownership of your resume, applications, messages, or other User Content.

35. Copyright and intellectual-property complaints

A person who believes that content on Bulbul infringes their rights may contact:

support@bulbul.ca

The notice should include:

  • identification of the protected work or right;
  • identification of the allegedly infringing content;
  • the complainant’s contact information;
  • an explanation of the claim;
  • a statement that the information is accurate and submitted in good faith.

Bulbul may remove or restrict content while reviewing a complaint.

36. Third-party services and external links

Bulbul may rely on third parties for hosting, authentication, email delivery, payments, analytics, security, search indexing, communications, and other operations.

Some jobs link to external Employer websites or applicant-tracking systems. When a Candidate leaves Bulbul:

  • the external operator’s terms and privacy policy apply;
  • Bulbul does not control the external site;
  • Bulbul is not responsible for the external site’s content, security, availability, or information practices, except to the extent responsibility cannot legally be excluded.

Users should independently review external sites before submitting information.

37. Communications

Bulbul may send necessary communications concerning:

  • account verification;
  • security;
  • password resets;
  • applications;
  • messages;
  • invitations;
  • Employer and job reviews;
  • professional resume orders;
  • support and legal notices.

Optional marketing, product updates, alerts, or promotional messages will be subject to separate preferences and applicable consent requirements.

Accepting these Terms does not constitute blanket consent to all commercial electronic messages.

Where required, optional commercial messages will include an unsubscribe mechanism. CASL guidance requires unsubscribe requests to be processed within 10 business days and without cost.

38. Service availability and changes

Bulbul may:

  • perform maintenance;
  • modify or discontinue features;
  • introduce limits;
  • suspend features for safety, security, or legal reasons;
  • release experimental or beta functions.

Bulbul does not guarantee:

  • continuous, uninterrupted, or error-free availability;
  • permanent storage;
  • compatibility with every device or browser;
  • that every feature will remain available;
  • that third-party providers will remain operational.

For an accepted paid service, Bulbul will remain responsible for obligations and remedies that cannot legally be excluded.

39. Suspension and termination

Bulbul may restrict, suspend, or terminate access where reasonably necessary because of:

  • fraud or impersonation;
  • fake companies, jobs, or applications;
  • unlawful discrimination or harassment;
  • misuse of Candidate information;
  • sourcing re-identification;
  • security threats;
  • malware or unauthorized automation;
  • non-payment;
  • repeated or serious violations;
  • legal or regulatory requirements;
  • safety concerns.

For less serious issues, Bulbul may provide notice and an opportunity to correct the violation.

Immediate action may be taken where delay could create fraud, security, legal, discrimination, or safety risks.

40. Appeals

A User may appeal a material:

  • company rejection;
  • job rejection;
  • account suspension;
  • sourcing restriction;
  • content removal.

Appeals must be sent to:

support@bulbul.ca

The appeal should identify the account, decision, and reasons for reconsideration.

Bulbul may request further information and will review the appeal in good faith. An appeal does not guarantee reversal.

41. Account deletion

Self-service account deletion may not be available.

A User may request deletion by contacting the email identified in the Privacy Policy.

Bulbul may verify identity before processing the request.

Deletion may be subject to:

  • legal retention duties;
  • open applications;
  • independently retained Employer records;
  • payment and tax records;
  • fraud, abuse, and security investigations;
  • legal claims;
  • audit records;
  • backups and technical limitations;
  • public caches outside Bulbul’s control.

Where a deletion request is received while a paid resume order is pending, Bulbul may pause the request and ask the Customer to choose whether to:

  • complete the order;
  • cancel it subject to the applicable cancellation rules; or
  • receive a refund where required.

42. Disclaimers

To the maximum extent permitted by law, the free Services are provided on an “as available” basis.

Bulbul does not warrant that:

  • User Content is accurate;
  • every fraud or violation will be detected;
  • Employers or Candidates will behave lawfully;
  • AI or ATS outputs are accurate;
  • the Services will be uninterrupted;
  • data will never be lost;
  • search engines will index or remove content;
  • external websites are safe;
  • using Bulbul will produce employment or recruitment results.

Nothing in these Terms excludes an express paid-service commitment, statutory warranty, consumer right, privacy obligation, or other liability that cannot legally be excluded.

43. Limitation of liability

To the maximum extent permitted by law, Sivaiah Technologies Inc. will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of opportunity, anticipated profits, goodwill, business, data, or reputation.

Subject to non-excludable rights, Bulbul’s aggregate liability arising from or relating to:

  • free Services will not exceed CAD $100;
  • the Professional Resume Service will not exceed the amount paid for the affected order.

These limitations do not apply where prohibited by law, including where liability cannot lawfully be limited because of fraud, wilful misconduct, or another non-excludable basis.

Some provinces or territories may not permit particular limitations. In that case, the limitation applies only to the maximum extent legally permitted.

44. Employer indemnity

To the extent permitted by law, an Employer will indemnify and defend Sivaiah Technologies Inc. against third-party claims, losses, liabilities, and reasonable costs arising from:

  • the Employer’s job postings;
  • hiring practices or decisions;
  • discrimination or employment-law violations;
  • misuse of Candidate information;
  • activities of Employer Users;
  • unlawful communications;
  • external application websites;
  • the Employer’s AI tools;
  • a breach of these Terms;
  • content or documents submitted by the Employer.

Bulbul will provide reasonable notice of an indemnified claim and allow the Employer reasonable participation in the defence, subject to Bulbul’s right to protect its interests.

45. Candidate indemnity

To the extent permitted by law, a Candidate will indemnify Sivaiah Technologies Inc. against third-party claims arising directly from the Candidate’s:

  • fraudulent or deliberately false content;
  • unlawful use of the Services;
  • infringement of intellectual-property or confidentiality rights;
  • unauthorized submission of another person’s information;
  • malicious content or security interference.

This clause does not require a consumer to indemnify Bulbul for Bulbul’s own negligence, breach of law, or non-excludable liability.

46. Informal dispute resolution

Before commencing a court proceeding, a party should send written notice to:

support@bulbul.ca

The notice should describe:

  • the dispute;
  • the relevant account or order;
  • the requested resolution.

The parties will attempt in good faith to resolve the dispute for 30 days after receiving sufficient notice.

This process does not prevent a party from seeking urgent injunctive relief, meeting a legal deadline, submitting a regulatory complaint, exercising a chargeback right, or relying on mandatory consumer rights.

47. Governing law and courts

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario.

Subject to mandatory rights in a User’s home province or territory, the parties submit to the courts located in the Region of Waterloo, Ontario.

Nothing in these Terms prevents a consumer from relying on statutory rights, remedies, jurisdiction, or procedures that cannot lawfully be waived.

No mandatory pre-dispute arbitration clause or class-action waiver is included. Ontario’s Consumer Protection Act preserves certain consumer court and class-proceeding rights despite contractual wording.

48. Notices

Bulbul may send notices by:

  • email to the address associated with the account;
  • an account notification;
  • a prominent website notice;
  • another method permitted by law.

Users must maintain an accurate email address.

A notice is considered received when delivered electronically, subject to evidence of delivery failure and applicable law.

Legal notices to Bulbul should be sent to support@bulbul.ca and should clearly state that they are legal notices.

49. English and French versions

Bulbul may make these Terms available in English and French.

Both versions are intended to have the same meaning. The version presented to and accepted by the User will govern, subject to any mandatory language rights and interpretation rules under applicable law.

No User is required to accept an English version where applicable law requires a French version to be provided or permits the User to choose the language of the agreement.

50. Assignment

You may not assign, transfer, sell, or sublicense your account or rights under these Terms without Bulbul’s prior written permission.

Sivaiah Technologies Inc. may assign these Terms as part of:

  • a merger;
  • financing;
  • reorganization;
  • sale of shares or assets;
  • transfer of the Bulbul business;
  • another corporate transaction,

subject to applicable privacy and consumer-protection requirements.

51. Force majeure

Bulbul is not liable for delay or failure caused by circumstances beyond its reasonable control, including:

  • internet or telecommunications failures;
  • power outages;
  • service-provider failures;
  • cyberattacks not caused by Bulbul’s failure to use legally required safeguards;
  • labour disruptions;
  • natural disasters;
  • fire, flood, or severe weather;
  • government action;
  • war, terrorism, or civil unrest;
  • public-health emergencies;
  • legal or regulatory restrictions.

This clause does not remove mandatory rights or excuse obligations that can reasonably still be performed.

52. General provisions

Entire agreement

These Terms, the Privacy Policy, applicable order terms, and any expressly incorporated plan terms form the agreement concerning the Services.

Where there is a conflict:

  1. mandatory law prevails;
  2. specific paid-order terms prevail for that order;
  3. these Terms prevail over general website statements.

Severability

If part of these Terms is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions continue.

No waiver

Failure to enforce a provision is not a waiver of the right to enforce it later.

Headings

Headings are for convenience and do not affect interpretation.

Survival

Provisions concerning intellectual property, User Content, payment obligations, retained records, disclaimers, liability, indemnity, disputes, and other provisions intended by their nature to survive will remain effective after account closure.
